I wouldn't be jumping up and down for joy just yet.

Apple can still do one thing. The U.S. recognizes their patents and could see to it that the product is not legal for sale or distribution in the U.S. or any other country that does recognize their patents.

If the product is found being distributed in more than one country that recognizes the patents, you could be tried in an international court at which point Polish law would not protect you.

So be careful and get real legal advice before you do anything.

I think Raduking's position is quite safe since as he explained it, he built his own genie effect many years ago even before Apple created it .

And as he said, he can proove that he created this effect before the patent was made so Apple cannot really sue him for copycat....

let me tell you something: my country does not recognise Apple's pattents and it never will since in one of the last few days Europe's parlament voted against Software pattents because of polland:

Yes indeed my compatriots politicians have blocked software pattents! So for now we can celebrate!! But it wouldn't be so great! At the begining they wanted to accept it but Polish government was continualy being forced by Polish PC users. Thats why we blocked this stupid bill! It's good to be a Pol!!

Cool... i would just like to see a real dock that actualy works.

I hate it when developers get their legs cut out from under them like Y did.

He probably could have tried to fight Apple and won, but at what cost.

I'm sure Stardock got "overlooked" by Apple because M$ works with them alot and M$ still own 20% or 30% of Apple's outstanding stock.

I had a search on google for the cease and decist letter that Mr Y received - but came up with nada. I know it exists as I've seen it! I'm trying to get it so that we can see the reasons why Mr Y'z was actually collared for i.e. icons/emulation or what?

I think to play it safe RK Dock should use alternate icons in its releases and another background (solid white?).

let's not talk about patents and legals anymore. I won't distribute their icons and I won't sell my dock. RK Launcher will be free. As for aladin lamp effect i will distribute it as a plugin if Apple says anything...

Have you considered releasing source code RK? If the source was floating around, it would be very difficult for Apple to stop it...

The icons aren't that bad. Those are actually higher quality then the ones in XP ( am i right? or am I just dreaming...) Anywho I would've done a icon set (no not vector style ) but I'm very very busy. Sorry RK.

EDIT: Oh, and may I ask why it has to be released with icons at all? Its not like we all dont have our own icons we can already use. No harshness intended, just a question!

Aquadock was just Y'z Dock with the name changed. From what I've read it seems that what they care about is what artwork is bundled with the program.

I think Smoke is right on this. I am a lawyer by profession and I would say that even if software patents are not enforcable in the EU there might be some intellectual property rights that you infringe with your app. There are some software patents already registered and in effect in the EU regardless of the fact that it is not generally allowed to register sw. patents. So to be on the safe side you might want to give the effect a unique name, bundle it with icons that are public domain (just make them changeable), release certain functions separately.

Design, layout, copyrights, ideas are all have some sort of legal protection under national laws, EU laws and international treaties, altough less powerful than patents, beacause the infringement is harder to prove. I am sure that Apple has the best lawyers money can buy

since there is no law in your country for the apple to love you. please release it with the genie effect on it. i know all of us are so excited to try the genie effect.

don't worry about the icons. even you pack it without it just like yz did. because we have our own set of icons to use. just add many background like milk, aero, longhorn glass, panther, tiger, black and etc.

i know you had a very hard time working on this. that is why i am very greatful and thankful.

anyway please release it soon. thanks a lot bro.
