Any Support Would Be Welcome

As you may have seen my site (mixtheix.com) is closed for further downloads.I have this problem with a software company called ADNX software that uses several of my icons in there software for wich they ask a lot of money.

The people of that company say to me 'to "naughty word" off' and that's it. As a protest I closed my site and ask on my site to sent complain letters to this company.

I ask you if you can (if you think i'm right) support me by overloading them with mail: )

In return I will make a template set for aquasoft members that they can make their own sets from and combine them with eachother. I won't release it anywhere else and it's copyright will be from Aquasoft.

Hope you support me on this. Thank you.

Hein Mevissen

You got my support. Those bastards.

Kindly provide the email addy for us to spam them. Is the website adnX.com?

EDIT: Oo, looky.

#90888

Sue? Their using your work (without permission) and refusing to remove it after you asked/queried about their use. I say sue.

Plus post the email so we can have lots of fun bumping it around the net.. ;)

[Edit];

My responce to their "replies" would be;

1. Doesn't that still mean that you could inform the French authorities of this copyright infringement?

2. So stealing the work of an "unknown" artist is okay? <_<

3. A distrubted product is not private use. Idiots.

4. If it was a Pay-to-Download icon, it would still have the same rights as a Free downloadable one. That lawyer is wack (or they're just making this bull up).

[Edit II];

Their email: webmaster@adnx.com Have fun :naughty:

#90889

Err, is profanity a requirement when we spam them or...? :naughty:

#90890

We don't understand why a company

cant' use these icons for a product.

The creative say : it is reserved only for private user !

But when a customer of adnX use our software

this is a private use !

So this argument does not have any direction !

Oh god, they must be braindead or something.. That is to silly to be called an argument.. Dont they understand that it is illegal to take money for other peoples work? You sure got my support on this one themixer ;)

#90892

Just got back from the offenders site - I sent 2 emails . They even have a copyright assurance on their front page . What a joke . I told them I would never consider buying any of their software until this matter is resolved . Thanks for your Icons Hein . My machine would not be the same without them .

How is profanity going to help the cause?

It just makes it look like we're uneducated little dullards whom the company can trample all over. <_<

#90907

It's just spam, StevieBM. Send messages however you like, just so they get the message. Besides, they seem like the dullards, and I'm receiving my master's degree in economics in two months.

edit: Xth message sent

Our french lawyer say that the creative artist

can't reserve an icon to a community.

When an icon is free for a community, anybody can use it !

If the artist want to protect an icon,

it should not publish for free on Internet

hey, i'm gonna move to france, so Apple can's sue me for ripping off there Aqua Look

:D

according to french copyright law.

"Generally, only the copyright owner is allowed to make and authorize others to make copies of software, translations, adaptations, and so on. There are, however, exceptions in certain carefully specified situations."

also

"The normal French copyright rule is that a protected work may nonetheless be copied if the copy is for strictly private, non collective use."

if they are releasing your icons, with there software, i would say (in my non-lawyer opinion) that this is collective use, and not Private (as they are selling it)

also, they clam they are a french country, yes they have an address in france.

but there web-site is hosted on a server in Amsterdam NL.

Sending them e-mail saying FUK U U R MEAN AND I HOP U DIE

Is *not* going to accomplish anything. Quit acting like brain dead americans. Instead, be clear and precise about what you have to say. Kindly give them links to copyright laws, and information on exactly the laws they are breaking. Do some research first for crying out loud. If the company is located in france, do some research on french copyright and intellectual property laws. If all else fails, get a lawyer to write a C&D letter for you. Send them the C&D letter, and if they still don't respond, you can take them to court. I don't know what country you live in mixthepix, but if it's america, they will have to come to america to fight the case. Not the reverse. It will cost you some money, but consult a lawyer. You have a clear clean cut case. Upon winning you'll probably get a hefty reward, and they will have to pay for your lawyer and your court costs.

You've nothing to lose. Don't rely on immature computer geeks to fight your case. Not when you clearly have the law on your side.

Nice generalization of an entire community there. <_<

Ok.. maybe that was a little harsh. And i wasn't saying the whole community is immature computer geeks.

Merely trying to state the fact that

A) A lot of people, as they even posted. Will just send stupid FUK U emails.. which get nothing accomplished.

B) He has a clean cut legal case, don't rely on non lawyer internet geeks to try to fight a legal battle, get a lawyer.

#90920

Nah, I think it's okay to spam them with profanity. After all, it's just spam. It's not like a serious letter. Yes, it might not help a lot. But it'll let them knew that's actually people out there dissatisfied with their shenanigan. Let the lawyers and copyright experts deal with the legal stuff.

I do agree. He could just set Law Dogs on them and possibly make some cash out of it too..

Nah, it won't help. Yeah, it'll make you look a moron. Serious letters help. Spam muddies the water and does not. Repeat: *not* help at all.

#90933

i sent a serious enough one:

1. French laws include copyright laws.  In addition, your RIPPING of Hein's icons fall under international copyright violation

2. Even if you are getting stolen property from a 2nd party, you are still receiving and using stolen property

3. You are using Hein's icons commercially, not privately

4. WRONG! an artist can stipulate whether or not anyone can use their work commercially without/with permission or payment.  IE. see linux distrubution rules, or stock photo copyright rules.

5. You've got to be kidding right?  You just admitted that your using Hein's icons commercially.  So pay him or cease and desist.

Your company is obviously wrong... the longer you use Hein's icons, the more money you are liable for!

Get a better lawyer,

respectfully,

but i sent it 15 times.

Oops.

feels weird talking about this on a-s. i feel all strangelike.

#90937

Ok I have decided to take the less illegal route and just send 5,000 messages at once just to piss them off.

#90940

Or, we could just register their email at some spam-company or something? :P

#90943

er...

do you want me to...sort of.....destroy their company? i dont like em, i have had a look at their site, they arent my type of people. what do you say? i could:

A. Overload their server with email so it crashes

B. Give the server a virust that would be transmitted quickly and silently through the network then I press a button and all their hard drives are nuked (become unusable)

C. Just send them so much spam they cant stand it?

Er....illegal stuff but the stuff they are doing is too.

EDIT

Ok I have decided to take the less illegal route and just send 5,000 messages at once. Wish me luck!

A) Uhm.. are you serious? Unless you can send thousands of smtp requests a second.. i doubt there pop3/smtp servers would mind. Maybe you can send them gigs and hopefully fill up their harddrive! (har. har. har.)

B) Ya, e-mail it as OPENTHISPLEASE.EXE . I bet they open it. You seriously have no idea what you're talking about.. it's sad and counter productive.

C) that's the same as A isn't it? Just as ignorant.

---

All that aside, that does nothing, and all your plans sound like something a 12 year old with AOL would say they could do. If you're gonna actually take illegal action. I would say DDoS the hell out of them. I'm sure it's just a T3 at best.

But ya.. all that is counter productive and stupid. The best thing to be done is for hein to get a real lawyer.

oh and.. per my previous post.. i'd like to reinforce my statement about immature geek community. kthx.

----------

EDIT: from netcraft

The site www.adnx.com  is running Apache/1.3.27 (Darwin) mod_ssl/2.8.13 OpenSSL/0.9.6i PHP/4.1.2 on unknown.

They're running on an OSX box. I have no idea what pop3/smtp servers run in OSX. I'd imagine anything that runs on *BSD. So in that case, good good good luck with that horrible evil plan of sending 5000 emails at "once". It may lag their site for a good 5 seconds.

#90945

I just got this email back from them . This is what I sent them in response ,,,,

You seem to be very rude and inconsiderate people . I will never buy any of your software no matter what . Good luck to you . patrick

we prefer to pay a more inteligent artist for icons !

We will remove these icons in the future version of our software.
