Ooh, I feel sorry for ya. That stinks- maybe it's an OD bug. 
Weird....I don't have any problems dragging things to the trash in OD.
Don't feel alone - the OD recycle bin has NEVER worked properly for me. I keep reading all these stories about people who have no problems with it, but I've yet to see proof. :6
It can be done:
- if you hit exactly the middle of the icon
- if you don't release the mouse button on a transparent pixel
- if you use narrow magnification mode
- if your mouse speed allows for single pixel selection precision
- if your dock contains less Icons than:
(insert screen resolution by minsize log maxsize formula here)
in short:
too much the hassle at the moment.

did you tried to put your dock in horizontal position?? maybe it's a problem of position in the icon or something like that

If you kill the icon of Recycle bin using TweakUI, Recycle bin will be able to be used by Dock.
There is one question.
Is the Recycle bin System's of Dock?
I removed the recycle bin from my desktop and it works fine in the dock without any issues, so that could be the way.

is not working for me. I had always disabled recycle bin from deskop (its the first thing i do).
Im even using the latest tweak ui. 2.10.0.
The closest I could get to a working recycle bin was to make a shortcut to it in the root of my HD and add that to the dock. However, dragging doesn't work with this method, nor does the icon change to reflect full or empty. :rant:
albeik should be converting Yz bin to OD and then we should get a working trash (
)

I used Tweak-XP to disable the recycle....dont know if that makes a difference.
