Creative Commons Attribution-NonCommercial-ShareAlike 2.5 (let's start "ripping")

In an effort to curb all the crying and screaming about "rips" that has been occurring here lately, I will, from now on, be releasing anything I create under the Creative Commons Attribution-NonCommercial-ShareAlike 2.5 license, and I suggest that others do the same.

While the document itself is a bit long winded, and full of legalese, the most important part is as follows:

3. License Grant.

Subject to the terms and conditions of this License, Licensor hereby grants You a worldwide, royalty-free, non-exclusive, perpetual (for the duration of the applicable copyright) license to exercise the rights in the Work as stated below:

a. to reproduce the Work, to incorporate the Work into one or more Collective Works, and to reproduce the Work as incorporated in the Collective Works;

b. to create and reproduce Derivative Works;

c. to distribute copies or phonorecords of, display publicly, perform publicly, and perform publicly by means of a digital audio transmission the Work including as incorporated in Collective Works;

d. to distribute copies or phonorecords of, display publicly, perform publicly, and perform publicly by means of a digital audio transmission Derivative Works...

Basically, what it's saying is "rip my work all you like, just include this license text in the file".

Crying and screaming over the arrangement of pixels, no matter how skillfully this is done, is absolutely ridiculous to me, unless one is charging a fee.

Have Unbe and Timmie made it clear about posting/releasing rips and WIP works? I mean Aquasoft IS THEIR site, so they can do anythng they wish to it including making the rules, banning people violating those rules or even people they don't like. If you wanna play here, you just have to respect the rules, if you don't, just play somewhere else. It's useless IMO to bring this up again as this will surely turn into a flam war which most of us don't appreciate and don't want to see.

I really hope that this thread will be closed soon to avoid any further flaming.

Indeed it is a legal issue, but who's in charge of making the law here at Aquasoft? I think they are... just so you know. Posting a thread with such title (let's start ripping) is not going to solve anything. Don't get me wrong though, I have nothing against you as with anybody here, I just don't want this place to be shut because of flaming, I think you've been here long enough to understand what I'm trying to say.

He is just stating what he is going to do with his work and suggested others should do the same nothing wrong with that.I always thought this "mine,mine,mine" mentality was not in the spirit of the community anyway.

I don't see this as laying down the rules at all. Its someone taking a mature look at the situation and saying 'OK from now on - this is how I will offer my work!".

I think it solves a few issues but also raises a few others. at the end of the day its down to the individual to say how their work is used, and with things that have happened in the past I don't see this problem going away over night.

Did you have to start a new thread expressly for the purpose of stating this?The title is misleading..."let's start 'ripping'" refers only to your work, but people could think otherwise. If it IS only your work, just tell people you don't have a problem with them using it, and you wouldn't even have to resort to legalities.

In my opinion, this thread has little point. It acts as flamebait, which is against the rules. If it's your work, fine--I don't have a problem with it. Do whatever you want. But you should just post this (or something to this extent) in your release threads, not as its own thread. To do otherwise is to invite discussion of this point, which in turn leads to arguments, closed threads, and bans (not that one logically leads to the next, but sadly, that's how these things progress).

"let's start ripping" is a joke. I have a quirky since of humor, and was also making fun of all those who jump up and down about being "ripped off".

I offered the license text as a solution to *all* our problems. If someone doesn't want to use, fine. But I'd suggest they not start screaming when their work gets "ripped" -- it will -- when a clear, and viable, solution as been offered to them.

The thread is only flamebait to those whose inclination it is to flame anyway. So far, everyone -- except for you and Duyvan -- has offered rather mature and insightful comments.

When you post whatever with the NFR at the description ,it's like standing infront of an unleashed dog with bones in your hands and waiting not to get ripped and bitten . This is a community forum and if you don't understand what is the idea behind the word community go play with your bucket to an other beach .

You can't flash a shiny wallpaper - iconset - visual style - skin - widget and expect 40.000 members and i don't know how many visitors to look at your something saying wow this guy is so cool . YOU ARE NOT SO COOL . You are a flashing selfish guy or girl expecting people's admiration in order to brag that you are SOMEONE. Beside that i don't believe that you never wanted to have something an other guy or girl had . Whoever say so is a liar .

Last word: Don't want your NFR to get ripped ,don't post in community forums. Make your forum , post your NFR in there , give passwords to your minions and be a God for them .

i agree. NFR does not include "not for ripping" (no point even if it did)

for every NFR you write there'll be at least 10 people who will try and rip that very instant. many people take it as a kind of elitism and will definitely try and get one up on you

agreed that most of us here will respect your sentiment and say "cool wall" or vs or whatever it might be, you still can't discount the fact only a fraction of those who have ripped your wall will actually go ahead and post it (even fewer on the same forum). those are the people who want you to know that NFR means nothing to them (though for some its a way of trying to level up with your desktop)

Aqua-Soft has never said it was OK for ANYONE to post anything that was a rip of some sort. If something is posted that turns up to be a rip, please report it. Do not post in the thread saying "omg you ripped this blah blah blah" REPORT IT! You're only making yourself look like more of an idiot posting the person ripped someone off, just let the staff know.

Another new issue that has been around the forums for the past few weeks, is this thing about rips in screenshots... Listen, if someone posts a screenshot of his desktop in say the desktop threads, and it turns out to contain work made by someone who has not released or whatever the means might be... it is allowed. As long as they are not redistributing the theme here on these forums, it is not our problem.

Now, I know that might piss off some of the artists/devs/whatever that spend a lot of time on their work. But this is the internet, if you take the risk of posting a screenshot of your work in the first place, then you know darn well it has its chances of someone coming along and having their fun with that screenshot. If you don't want your stuff ripped, don't post your stuff unless you're finished with it.

I listen to the members feedback, if you guys have a problem with anything I said feel free to rant on.

Just ask yourself at the end of the day. Is it worth *****ing about?

I've sat on the sidelines and quietly observed this ripping phenomenon battle whatever you wanna call for long enough. Here's my "expert analysis":

Let's SIMPLFY the issue:

It's all about RESPECT and COURTESY.

Sure, we can debate and fuss about what I can show or distribute of the work I stole from you, but if this is to be a community, shouldn't we err on the side of courtesy? Shouldn't I ask if I can have or use your work? If you're the keeper of your work, would it be better if you gave a reason for holding on to your work? I'm sure we'd be upset but we'd understand and respect it, and it'd seem less selfish (unless your reason was just to be elite, don't most people want to release their work to be recognized?).

Our priority should be to protect people and their work, which in turn fosters a more generous community. I think MOST of us can be respectful and courteous. If you can't then

1) log off your computer, and go back to screaming and singing on HALO2/XBL

2) PM unbe and ask to be banned

This creative commons agreement is a GREAT idea but it DOES NOT address the problem. The people who are having their work ripped and our best talent would probably not release their stuff under this agreement so it doesn't address the problem.
