FlyakiteOSX ripped - and this guy has balls

Its not copyright infringement guys...

#339484

This is just horrible, I know what it's like to have someone steal your work and pass it off as their own. I used to work with a guy that did it all the time for clients of his.. it's a horrible practise.

I hope this individual responds quickly and removes the material from his site.

Yes... it is.

"What is a copyright notice? How do I put a copyright notice on my work?

A copyright notice is an identifier placed on copies of the work to inform the world of copyright ownership that generally consists of the symbol or word “copyright (or copr.),” the name of the copyright owner, and the year of first publication, e.g., ©2003 John Doe. While use of a copyright notice was once required as a condition of copyright protection, it is now optional. Use of the notice is the responsibility of the copyright owner and does not require advance permission from, or registration with, the Copyright Office. See Circular 3, Copyright Notice, for requirements for works published before March 1, 1989, and for more information on the form and position of the copyright notice.

What is copyright infringement?

As a general matter, copyright infringement occurs when a copyrighted work is reproduced, distributed, performed, publicly displayed, or made into a derivative work without the permission of the copyright owner. "

Some light reading... http://www.copyright.gov/help/faq/faq-general.html#what

Also, if Chris chose too... he could trademark his FlyakiteOSX logo.

#339489

yep, he can :D and I offer all my support to Chris and I'm able to help if needed.

#339490

I'm as outraged as anyone about this.. but what I think we all are failing to acknowledge is that FlyakiteOSX itself is infringing on Apple's copyrights.

#339495

True... the contents of FlyakiteOSX is infringing, the packaging and name is purely Chris'.

#339497

Exactly, thats why its something you can only gripe about so far. Yes it does suck, and I can understand if flyakite is not happy about this.

But what can you possible do to prevent this?

Keep in mind I do not like seeing members causing problems with other peoples sites. That is not something you should be doing imo.

Lets contact his host, lets do this, lets spam his site, lets boycott... lets grow up?

If flyakite wants, all that he can do here, is ask for me to filter out his site, which I would be happy to do.

#339503

Well, if you needed something so desperately, that you had to come in my house and steal it, why should I bother myself by getting upset over it?

Granted, I may not like it very much, but I'm not going to be upset over it...

This why we so much war, conflict and murder going on these days anyway -- all this "I" making, "me" making, "my" making and "mine" making -- that the unaware choose to engage in.

Still with the same crap as before, Grusic?

But yeah, I agree with Timan, what can you do?

#339516

ummm.. This doesnt seem malicious in anyway. He is restating what chris has stated on his website. He is providing the downloads for free. He isnt saying that he made Flyakite OSX. Oddly it seems as if he is a fan trying to help out with bandwith and to spread flyakite OSX

If he did originally intend to take all the credit for himself then yeah thats pretty ****ty... but if he asked for permission and stuff I dunno. Seems kinda like much ado about nothing but I could be wrong since I dont know the situtation.

Yeah, I agree the FAQ section clearly states

"Credit for FlyakiteOSX

Credit is given to Chris Kite, the original creator of FlyakiteOSX. Please visit the site here. "

He may be making money off the ads though..

#339523

That was added after he was contacted by Chris I believe

#339536

Well, actually it is infringement b/c he is making money off of it. ads as well as the selling of the domain. in almost every possible way, its infringement.

#339554

what a dirt bag

hope he gets shutdown or arrested for making money off other people's work

#339566

you can copywrite the flykite logo and get him that way

#339570

Flyakite I support and agree with you. As I said I really couldnt say because I didnt know the whole story. I certainly wouldnt want someone registering bzeitler.com and mirroring all of my stuff :S Anyhow. Hope it doesnt deter you from your great work.

Take care.

#339589

I see my errors...It didn't seem that bad originally, but by making money off the ads and throwing other people off into thinking that flyakite was set up by him...this guy really is screwing with Chris...Hopefully, things can get back to normal once his site is 'corrected' or simply shut down.

#339614

Chris,I suport you.

And I shame for the kind of steal site.

#339616

weird.. while looking for an alternative to placesbar editor, I came across (aptly named) xtort.net which links to the site flyakite is talking about... and then I noticed this at the bottom:

Please Note: http://osx.portraitofakite.com is the official site for FlyakiteOSX. This site is NOT associated with this software at all.

I guess that is in response to flyakite's last email.

edit: @flyakite - xtort net contact mail if you want them to change link/info/etc; contact page

#339681

with those notes i think http://www.flyakiteosx.com is a good mirror download site :-)

I see nothing outragous about this website. To me it's just a mirror of FLyakiteOSX...

As long as the owner of the site has permission from Chris then it is perfectly fine. It seems the person hasn't added in any viruses/spyware etc or charged for it, and he isn't trying to take the credit.

Although I think he should make it a little more obvious that he did not make it; like saying "FlyakiteOSX by Chris Kite"

#339969

Right. Give credit where credit is due.

I don't know when you checked the site, but before sometime yesterday the credit saying that the site is not the official site, etc. was NOT on there. And its not the website that bothers me, no one seems to understand. What bothers me is the author did not actively do anything to tell people that this is not his work. I mean seriously, you go to a website with a domain named after the software, and there is no notice on the front page (you have to go to the FAQ page, read everything till you get to the bottom and find out), so most people will automatically assume its the official site and he is the author.

What REALLY pisses me off though is that he submitted the software to sites such as Download.com and many, many others and lists himself as the developer/publisher. Its a blatant attempt to get traffic to his site to make money off of ads.

Also, there is NO section on the site crediting the other people who have contributes to the project. I try my best to make people realize that I did not create everything. I have credits in the installer and on the site crediting those who have contributed something I have included. www.flyakiteosx.com has nothing like that, and so those authors are not getting the credit they deserve.
