Well, you are violating copyright, thats a fact.
if that's the case, i'll gladly take it down. but the obvious question is what about all the instances where the apple logo is used on many of the wallpapers found here? Or when mac icons are used as a base for new icons, as I have done? is this whole site one big copyright violation, since mac icons are used on the menubar? shouldn't everything be taken down then? as i have learned, giving credit doesn't equal permission.
Well, you are violating copyright, thats a fact.
Well... most Macintosh icon sets are not hosted on deviantART. You will not find a system replacement set ripped from Apple on devART. You will find sets made from scratch to replace Apple's standard icons.
Because your icon uses an Apple icon as a base (with very little modification), deviantART took it down. I like the icon though. 
Feel free to leave it up for us to use. Although we have a problem with artists ripping from other artists, we generally don't mind if they rip Apple or Microsoft (although the latter is never pretty 
).
Here I was thinking it was Lego whose copyright was infringed.
