That was to be a joke and then I realized that it means Bill Gates would have to patent himself.

They didn't patent "the apple tree", you fools.
They patented a specific type of apple tree.
Someone else owns the patents for what we all know and love as apple trees.
Oh, and for what it matters, plant patents are just there so that no-one can claim that they made it, and so that people can control the sales of seeds and so forth. Does anyone really think that MS is getting into the horticultural supplies industry?

I think so.
Actually what happened was that some guy wanted to patent this type of apple tree and used the same law firm that MS uses to patent stuff, and they screwed it up and made the paperwork out to MS:
ZdNet has the blurb about it.
Just goes to show you, if there is a god, he's got a good sense of humor

Microsoft was never that smart, even tho it was the firm that scewed up.
They really should have asked them selfs while doing the paper work, why would microsoft want an apple tree?
